Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Scoopwise (the “Service”), operated by Wanderverse Studios LLC, a Florida limited liability company (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service

Scoopwise is an operations platform for ice cream truck businesses. Drivers log sales (including while offline), and owners get end-of-day close-out, KPIs, and record exports — from a single truck to a fleet.

Eligibility, accounts, and staff

You must be at least 18 years old and authorized to enter into these Terms on behalf of yourself and your business. You represent that you are using the Service for business or commercial purposes and not as a consumer.

You sign in through Google or Apple and are responsible for all activity under your account, including use by your drivers and staff. You are responsible for provisioning access for your staff, for ensuring they comply with these Terms, and for promptly revoking access when a person leaves or no longer needs it. Keep your sign-in credentials secure and notify us promptly of any unauthorized use.

Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Attempt to access data belonging to other operators, or any part of the system you are not authorized to access.
  • Interfere with, disrupt, or overload the Service.
  • Scrape, crawl, or access the Service through automated means except through interfaces we provide for that purpose.
  • Share a single account across separate or competing operators, or resell or provide the Service to third parties except as we expressly permit.
  • Reverse engineer or copy the Service except to the extent that restriction is prohibited by law.

Your data

You own the business and operational data you put into Scoopwise. You grant us a limited license to host, process, and display that data solely to provide and improve the Service. Our handling of personal information is described in our Privacy Policy.

Record exports (for example, spreadsheet or tax-ready files) contain the data in your account at the time of export. They are provided for your convenience and are your data. They are not an audit, a certification, or a guarantee of accuracy.

Records and calculations, not advice

Scoopwise records the sales, stock, and shift information you and your drivers enter, and performs calculations on that information — such as totals, close-out comparisons, and profit figures. These calculations operate on the data you provide; Scoopwise does not independently verify that the underlying entries are accurate or complete.

Scoopwise is not tax, accounting, legal, or payroll advice. It does not process payroll, and it never moves, holds, or disburses money to anyone. Any hours, pay, or profit figures are provided for your convenience only. You are responsible for reviewing and validating all figures, and for your own tax, legal, employment, and licensing compliance.

Your responsibilities

You are responsible for:

  • The accuracy and completeness of the sales, stock, shift, wage, and product data entered into your account.
  • Your own taxes, permits, licenses, wage and hour obligations, and other regulatory compliance for your business, drivers, and staff.
  • Reviewing and finalizing your own end-of-day close-out and periodic records; Scoopwise assists with this but does not replace your own review.
  • Obtaining and maintaining the compatible devices, internet connectivity, and mobile data plans needed to use the Service, including any data charges you incur.

Subscriptions and billing

Paid plans, when offered, are billed through Stripe. Pricing is $50 per month including your first truck, plus $25 per month for each additional truck, or as otherwise stated at the time of purchase. Prices are exclusive of any applicable taxes, which you are responsible for where they apply.

Free trial. New accounts include a one-month free trial. When the trial ends, your subscription automatically begins at the then-current price unless you cancel before the trial ends. Any specific trial terms shown at sign-up control.

Automatic renewal. Paid plans renew automatically for successive periods at the then-current price until you cancel. By subscribing, you authorize us, through Stripe, to charge your payment method on each renewal. We disclose the renewal terms clearly before you subscribe, and the renewal terms are these.

Truck-count changes. Adding a truck takes effect when you add it and is charged on a prorated basis for the remainder of the current billing period; that truck is then included in your next renewal. Removing a truck takes effect at the end of the current billing period, and prepaid time for a removed truck is not refunded.

Failed payments. If a charge fails, we (through Stripe) may retry it, and we may suspend or downgrade your access until payment succeeds. We will restore access on successful payment.

Chargebacks. If you dispute a charge you legitimately incurred, please contact us first. Initiating a chargeback on a valid charge may result in suspension of your account.

Refunds. Except where required by law, payments are non-refundable, and we do not refund partial or unused periods.

Cancellation

You can cancel at any time, either in the app or by emailing us, with no requirement to call or speak with anyone. Cancellation takes effect at the end of your current billing period, and you keep access until then.

Availability, syncing, and changes

We may add, change, or remove features, and we may modify or discontinue the Service.

Offline logging and data synchronization are provided on a best-effort basis. Ice cream trucks operate in areas with poor or no connectivity, and we are not responsible or liable for data that fails to sync, is delayed, is overwritten, or is lost as a result of network interruptions, device or app settings, local storage being cleared, app uninstalls, or device errors. You are responsible for reviewing your records periodically and for your own final close-out.

We are not liable for any loss arising from unavailability of the Service.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, Wanderverse Studios LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or US $100.

Indemnification

You agree to indemnify and hold harmless Wanderverse Studios LLC from claims and expenses arising out of your use of the Service, your data, or your violation of these Terms.

Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, fail to pay, or to protect the Service or other users. Provisions that by their nature should survive termination will survive.

Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Florida.

General

These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
